delete race condition during backup

I have searched the existing issues, both open and closed, to make sure this is not a duplicate report.

The bug

during backup, select multiple photos and/or videos, delete. (confirm when asked). all selected are deleted from phone locally, but assets that get uploaded during this backup session, is kept on server

1. take 1 photo and 1 video, repeat this multiple times to make longer backup time
2. open immich, let backup start (check the sync icon)
3. select photos/videos that just took, which are being backup
4. select delete, confirm
   ...
